This privacy and cookies policy (“Privacy Policy”) governs the web and mobile sites, applications and services for www.wyndow.com, www.gowili.com, and the Wyndow applications. For the purposes of this Privacy Policy, both websites and applications will be referred to as the "App". The App is operated by Gowili, Inc. (“Gowili” or “we”).We are committed to protecting your privacy online. We appreciate that you do not want certain personally identifiable information (such as your name and email address) (“Personal Information”) you provide to be indiscriminately distributed, and provide below how we collect and use information, in addition to your rights and ability to control this information.By using the App, you consent to the collection and use of information in accordance with the terms of this Privacy Policy. This Privacy Policy is incorporated into and is subject to Wyndow Online Terms of Use (“Terms of Use”). Your use of the App and any Personal Information you provide on the App remains subject to the terms of this Privacy Policy and the Terms of Use. Please note that any Personal Information or content posted at your direction or by you in the App that you voluntarily disclose online (such as in chat rooms, bulletin boards or other activities) that becomes publicly available, is not considered Personal Information subject to this Privacy Policy. We reserve the right to change this Privacy Policy from time to time by changing it on the App. This Privacy Policy was last updated on February 26, 2015.

For All Children: If you are under the age of thirteen (twelve or younger) you may not provide any information about yourself to the App. While you may view content on the App, you may not register with the App, use the App, enter any of our sweepstakes or contests, or participate in any of our chat rooms, bulletin boards or other activities that would let you enter information about yourself or otherwise interact with other users. However, if you should choose to withhold requested information, we may not be able to provide you with certain services.

How We Use Your Information: We will use the information you provide to:help us to build a profile of your preferences so we can offer you events and services you are interested in;enable us to process your orders and to provide you with the services and information offered through the App and which you request;administer your account with us;In the future, verify and carry out financial transactions in relation to payments you make through the App;share with third parties necessary to process your transactions with us, such as credit card companies, banks and ticket dispatchers;share with our merchants for the purposes of redeeming the tickets you purchase from the App;exchange information with other companies for fraud protection and credit risk reduction;contact you by post, phone or email when necessary to discuss the transactions entered into by you on the App;audit the downloading of data from the App;improve the layout and/or content of the pages of the App and customize them for users;identify visitors to the App;carry out research on our users' demographics and tracking of sales data;share with social networking sites at your request; and disclose to lawful authorities when required to do so by law.We will also use information you provide to us for the purposes of contacting you with information or offers regarding upcoming events, products, services or surveys. This shall only be done with your consent and our direct marketing policy which is explained in full below.

Additional Information: When you visit the App, we may automatically collect additional information about you, such as the type of phone or operating system you use and, if you came to the website, the type of internet browser you use and the website from which you have come to the site. Also, depending on whether you access the App on your PC, mobile device or through another platform, we will collect your IP address (the unique address which identifies your home computer on the internet) or the unique identifier (which is linked to your mobile device) which are automatically recognized by our servers. You cannot be identified solely from this information and it is only used to assist us in providing an effective service on the App and to collect broad demographic information for aggregate use.The website uses pieces of information that the website transfers to your hard drive to store and sometimes track information about you (“Cookies”). Social Media: When you contribute to a public area or social media feature of the App, such as a blog, wiki, list serve, chat room, bulletin board or other communication or community tool or area, the information that you submit will be made available to the general public. For this reason, we recommend that you do not submit any sensitive information, including your full name, home address, phone number, other information that would enable other users to locate you, or financial information on these areas of the Service. Instead, make up a username that does not disclose your personal identity.When you comment or click “Like” or “Dislike” on content on using Facebook or another social network via the App, your comment or “Like” or “Dislike” opinion will be displayed on the App and also on you own social networking profile, and it will be viewable by anyone who is able to view your social networking profile depending on the privacy settings you have set in your social networking account. Depending on how you have set the privacy settings, your posing may also be broadcast to other users of the social network via the App. The privacy policies of your social network service also apply to the information you provide using these features.When you participate in our user community activities on Third Party Platforms the information you submit will be received and used by such Third Party Platforms, pursuant to their privacy policies and will also be received by the App for its use in accordance with this Privacy Policy.

Third Party Advertisers: To the extent that the App carries advertising by third parties, we use digital advertising technology companies to deliver the advertising to you. The non-personally identifiable information collected by these companies, for example, about your visits to this and other sites and services is used for the purpose of targeting ads and measuring ad effectiveness on behalf of advertisers and publishers who specifically request it.Service ProvidersWe may use third party partners to help operate the App and to deliver our products and services, and may share your information with our affiliates, service providers and other third parties that provide products or services for or through this App or for our business (such as site or database hosting companies, address list hosting companies, Wireless Carriers, Third Party Platforms, aggregators, e-mail service providers, analytics companies, distribution companies, fulfillment companies, and other similar service providers that may use such information on our behalf).Right to Opt OutYou may decline to submit Personal Information through the App, in which case Gowili may not be able to provide certain services to you. Additional Information About Social Networks: By participating in certain networking and content sharing Services, your personal information may be made available to other members of the network who may contact you and otherwise correspond with you. You may have the opportunity to choose a specific contact point to be used by such other members for such purposes (including, for example, your e-mail address, SMS address, phone number, etc.). If you do not decline to receive such messages at the time you provide your information, or if you change your mind and no longer want to receive any such messages from other members of the network, you may make such request by visiting the “Preferences” area/page of your account on the network and changing your elections, or by following the instructions set forth in the Right to Opt Out section above.

Wireless Addresses: If the e-mail address you provide to us is a wireless e-mail address, you agree to receive messages at such address from Gowili, Inc. directly or via the App (unless and until you have elected not to receive such messages by following the instructions in the Right to Opt Out section above). You understand that your Wireless Carrier’s message and data rates may apply to these messages, and that you may change your mind at any time by following the instructions in the Right to Opt Out section above. You represent that you are the owner or authorized user of the wireless device on which messages will be received, and that you are authorized to approve the applicable charges.Short Message Service (“SMS”)We may make available on or through the App a service through which you can receive messages on your wireless device via short message service (“SMS Service”). If you subscribe to one of our SMS Services, you thereby agree to receive SMS messages at the address you provide for such purposes (unless and until you have elected not to receive such messages by following the instructions in the Right to Opt Out section above). You understand that your Wireless Carrier’s message and data rates may apply to these messages. You represent that you are the owner or authorized user of the wireless device you use to sign up for the SMS Service, and that you are authorized to approve the applicable charges. To use the SMS Services, you must be either 18 or 13 years of age or older (depending on which SMS Service you want to use and your carrier restrictions) and reside in the United States.

Integration and Interaction with Third Party Platforms and Services: The App may be linked to, rely on and/or be integrated with websites, applications, interfaces, services and platforms operated by other companies located throughout the world. The App may also feature advertisements from other third parties. We are not responsible for the privacy practices of such third party websites, applications, interfaces, services, advertisements and platforms. Once you leave the App via a link, application, interface, service, advertisement or platform or click on or navigate to an advertisement, you should check the applicable privacy policy to determine, among other things, how they will handle any personally identifiable or other information that they may collect from you.

Your California Privacy Rights: If you are a resident of the State of California, we provide you with information on how to exercise your disclosure choice options such as your right to opt-out (which we may sometimes refer to as “unsubscribe”) with respect to use of your Personal Information by third parties for marketing purposes. Therefore, pursuant to the California Civil Code, we are not required to maintain or disclose a list of the third parties that received your Personal Information for marketing purposes during the preceding year. We will not accept requests via telephone postal mail or by fax. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

Accuracy: It is your responsibility to give us current, complete, truthful and accurate information, including Personal Information, and to keep such information up to date. We cannot and will not be responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information of Personal Information or if you fail to update such information or Personal Information. We will reject and delete any entry that we believe in good faith to be false, fraudulent or inconsistent with this Privacy Policy or otherwise inappropriate for the App.

International Usage: The App is controlled by Gowili, Inc. from its offices in the U.S. If you download, interact and/or otherwise use the Service from a location outside the U.S., please be advised that any information you provide, or that is collected by us as described herein, may be processed in and/or transferred to the U.S. and/or other territories and locations, where privacy protections may not be as comprehensive as those in the territory or location where you download, interact with or otherwise use the Service. However, we will only process your Information in accordance with this Privacy Policy. By using this App, you affirmatively consent to this transfer and to the use of your information as described herein.

Public Forums: The App may, from time to time, make public forums available to its users. Any information that is disclosed in these areas becomes public information and you should exercise caution when using these and never disclose your Personal Information.

External Links: The App may, from time to time, contain links to external sites. We are not responsible for the privacy policies or the content of such sites.

Payment Processing: Ticketed events on the App will often transfer you to the third party event/ticketing purveyor for payment processing on their site. However, from time to time, some events on our App may be processed by the App. Payment details you provide will be encrypted using industry standard 128 bit secure sockets layer (SSL) technology before they are submitted to us or our payment partners over the internet. Payments made on the App are made through our payment solutions providers (PSP). You will be providing credit or debit card information directly to the PSP which operates a secure server to process payment details, encrypting your credit/debit card information and authorizing payment. We do not store your credit card number or security code on our servers, though it may transit through our servers as it passes to PSP. Information which you supply to our PSP is not within our control and is subject to PSP's own privacy policy and terms and conditions.

Marketing to You: We may send you information we think you may find useful or which you have requested from us by push notification and/or (if you provide us with your e-mail address) by e-mail, including information about the latest or upcoming events featured on the App, provided you have indicated that you do not object to being contacted for these purposes and we will always give you the option to opt-out of receiving further e-mails or push notifications by following the unsubscribe instructions on any communications sent to you.Additionally we may allow our merchants, and if you consent by opting-in to receive such information and offers, other carefully selected third parties, to send you information directly which you may find useful regarding their products and services.You can tell us not to contact you with information regarding the products or services of third parties, or to share your details with third parties so that they can directly send you information regarding their products and services, either at the point such information is collected on the App (by checking the relevant box), or where you do not wish us to continue to use your information in this way by following the unsubscribe instructions on any communications sent to you.You can also exercise this right at any time by contacting us using the contact details at the end of this Privacy Policy.When you purchase a ticket through the App, you may at that time be offered an opportunity to purchase third party products or services or enter third party promotions or loyalty programs. If you expressly consent to purchase those products or services or enter into the promotions or programs you authorize us to share your name, e-mail address and, where necessary and only where you have consented for us to do so, your financial and billing details with that third party merchant. The use of your Personal Information will be governed by the terms of that merchant's own terms of supply and privacy policy, so ensure that you read the relevant terms and privacy policy carefully before you agree to purchase from, or participate with that third party merchant.

Your location Data: In order to get the most out of our service and to allow us to provide you with tailored offers, we need to process your approximate location from time to time. The types of location data that will be processed are your latitude, longitude, cell tower ID, etc. Your location data will only be processed for as long as necessary in order for us to respond to your request for tailored offers, or if you opt-in, to provide ongoing real-time push notifications. The location data may be transferred to our merchants for the purpose of providing you with the best offers at that time to match your preferences.You can choose not to allow us to process your approximate location at the time you connect to the App, or any time after that either by changing the settings on your mobile device or by contacting us using the contact details at the end of this Privacy Policy. Please note that if you choose not to allow us to process your location data, we will not have enough data in order to provide you with the full benefit of our service (e.g. a list of tailored offers matched to your approximate location).SecurityWe place great importance on the security of all personally identifiable information associated with our users.
